1. General Terms and Conditions

These Terms and Conditions define the rules and regulations for the use of the "Milla Chang Arts" website.
By accessing this website, we assume that you accept these Terms and Conditions in full. Do not continue to use the ""Milla Chang Arts"" website if you do not accept all the Terms and Conditions for the services mentioned on this page.
The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice, as well as any and all Agreements:

"Customer", "User", "You" and "Your" refer to you, the person who is accessing this website to accept the Terms and Conditions of the "Milla Chang Arts" website;

"Website", "Online Store", "We" and "Our", refer to the website "Milla Chang Arts" and/or the artist Milla Chang;

All terms refer to the offer, acceptance and payment necessary to complete the process of purchasing our products, in accordance with and subject to, prevailing law of Portugal.

2. Ownership

"Milla Chang Arts"" virtual store (also designated as online shop or e-shop) on the Millachang.com website is owned and operated by Milla Chang, NIF 271118741, artistic name registered with IGAC (General Inspection of Cultural Activities) under number no. 1497/2023, in Portugal.

3. Copyright - Intellectual Property Rights

Unless otherwise noted, Milla Chang and/or its licensors owns the intellectual property rights for all material published on the website.
All intellectual property rights are reserved and protected by law.
You may view and/or print pages from the website for your personal use subject to restrictions set in these terms and conditions.

4. Interdictions

It is strictly prohibited and punishable by law:

- Republish material from the website;
- Sell, rent or sub-license website content;
- Reproduce, duplicate or copy content from the website;
- Redistribute content from the website unless the content is specifically made for redistribution and expressed permission for such use.

5. Amendment of these Conditions

"Milla Chang Arts" reserves the right to freely modify the General Conditions at any time, in order to adapt them to applicable legislation, without need for any prior notice.
We also reserve the right to modify unilaterally and at any time, without prior notice, the presentation and content of the website regarding products, prices, promotions, commercial conditions and services. These modifications will serve to improve the website, simultaneously improving the services offered to the User.
Despite all the attention given when preparing the website's contents, the information, texts, graphic documents and/or other services may contain errors or be incomplete. In these situations, "Milla Chang Arts" cannot be held responsible for any damages resulting from the use (or inability to use) the website, including damages caused by viruses or any inaccuracy or imperfection of the information.

6. Commercial policy

The sale underlying each order placed by the Customer is made subject to retention of title, meaning that the products are the property of the artist until effective and full payment of the due amount.
The images and photographs of the products sold in the online store, despite trying to be as reliable as possible, are illustrative, so the Customer should consider the possibility of slight differences in color and appearance, which could also be due to the monitor and web browser used by Customer. Therefore, we recommend that the Customer carefully and in detail consults the product and its characteristics, in order to be sure of them at the time of purchase.

7. Order

While browsing the online store, the Customer will be able to view all available items and variants, being able to select the ones most appreciated. You must insert the items you wish to purchase in the virtual shopping basket (cart), and you can, whenever you wish, exclude any of the items previously inserted there, without prejudice to the ordering of other items. Once the selection process has been completed, you should review your order and check selected items and then complete the process. You must then proceed until payment, thus confirming the order.

Our online store tries to ensure that all items offered for sale are available for delivery. However, for unexpected reasons, "Milla Chang Arts" reserves the right not to accept any orders or to cancel orders already confirmed for products that are no longer available, that have been damaged or that for any other imperative reason are not in good condition to be sold. Our online store will immediately inform the Customer of the partial or total cancellation of their order, and the Customer is entitled, if applicable, to a refund of the amount paid.

8. Price Information

The public sale prices of goods, resulting from the artistic activity of art painter Milla Chang, indicated in the online store, are presented in euros (€), and are exempt from VAT (Value-Added Tax).
Should we detect an error in the price of a item in our online store, the Customer will be informed immediatly and given the option of confirming their order at the correct price or canceling. If it is not possible to contact the Customer, our online store will consider the order as canceled and all amounts paid will be fully refunded.

9. Shippment

Shipping costs are invoiced per order and are borne by the customer; the values are indicated according to the courier service selected by the Customer at the time of purchase process. This amount will be added to the total cost of the order.
Paintings and printings are shiped frameless.

Should the Customer prefer any other international courier services (DHL, TNT, UPS, FedEX, Inpost) other than those presented in the purchase process, the Customer must consult us prior to the payment using the form on the "FAQs" (Frequently Asked Questions) page. As soon as possible we will inform the Customer of the value of shipping charged by the selected courier operator of their choice. Only later should you confirm your order and complete the purchase process, and by doing so you agree to pay the additional shipping costs related to the use of the courier operator of your choice. The Customer will receive an online invoice by email to proceed with additional payment.

Orders sent to other countries than countries of European Union (EU) or with different customs and tax policies than most of countries of European Union, may be subject to taxes, customs duties and fees charged in the destination country (Import Fees). The recipient of an international shippment may be subject to Import Taxes when the package arrives to final destination country and may incur additional customs clearance charges. "Milla Chang Arts" does not control these charges nor does it result in an estimate. Customs policies vary greatly from country to country, so please contact your local customs office for more information. In cases where customs clearance procedures take place, there may be a delay in relation to the estimated shipping time.

10. Payments Methods

10.1. Payments in Portugal
MB Multibanco, MBWay, Bank transfer, cash, payments with debit and credit bank cards using Visa, Maestro, MasterCard, American Express, Discover, Stripe and PayPal systems.

10.2. International payments
Debit and credit bank cards using Visa, Maestro, MasterCard, American Express, Discover, Stripe and PayPal systems.

The bank card payment systems we provide are carried out through the Stripe and PayPal networks.
Stripe and PayPal are secure ways to pay and receive, currently widely used. All transactions carried out through these systems are protected by advanced data encryption.

The Customer must pay the exact amount specified in the confirmation of each order, and must do so using only the payment methods described above. Otherwise, if the Customer tries to use any other payment method, "Milla Chang Arts" cannot be held responsible for the loss of payment or any other damages that may result.

11. Confirmation or Cancellation

After making their purchase, the Customer must ensure that will receive an automatic email confirming the transaction, which must be printed or saved for future reference.
The order will only be processed after confirmation of payment. In case of non-payment or non-compliance or non-confirmation of these General Conditions, "Milla Chang Arts" reserves the right not to accept the customer's order, or to cancel it, even after automatic order confirmation.

"Milla Chang Arts" also reserves the right not to confirm and/or deliver the itms ordered by the Customer, regardless of the reason, and is exempt from liability for any damages or costs, in the following cases:

- if any unpredictable event or change to current circumstances arises that could affect production, transportation and respective costs, or that causes abnormal increases in the prices of raw materials;
- if, for any reason, it is impossible to properly collect and receive the respective payment;
- if the ordered products are no longer available or show any deterioration;
- if the order was placed with errors in the data essential for delivery of the order;
- if the order is flagged by the website's security systems as an incorrect, irregular order and/or considered fraud.

In any of the aforementioned cases, "Milla Chang Arts" will inform the Customer by email about such a situation where it is impossible to confirm the sale and the consequent cancellation of the order, refunding the amount paid for the items.
No reservations are accepted. Failure of payment for the order within the next 24 hours will result in cancellation.

12. Delivery

Items ordered at "Milla Chang Arts" online store will be shipped and delivered on business days, Monday to Friday.

During the purchase process, addresses for billing and delivery of the order will be requested. Good delivery of the order can only be guaranteed if these details are correct. The address mentioned is the sole responsibility of the Customer.
Delivery of the order is considered to be complet upon acceptance of the order at the agreed address and confirmed by the tracking of the order by the courier services. There are countries, such as Brazil, where parcel tracking is not carried out and therefore we will not be responsible for any loss thereof.

Upon delivery, the Customer must inspect the packaging and items received to check for any damage. Should any item or package show damaged, the customer must not accept delivery of the order and it must be returned immediately to its source. Otherwise, the order will be considered, from that moment on, accepted by the Customer.

13. Delivery Time

"Milla Chang Arts" only ships orders on business days. Therefore, to estimate the delivery time of orders, weekends and public holidays are not taken into account. Any delay in shipping items, given the estimated dates presented, does not entitle you to compensation.

The maximum estimated time for preparing the order is 3 days, except during festive or busy seasons when this process may change. "Milla Chang Arts" will notify the client if this happens.
After dispatch from our online store, the order must be delivered by the courier/carrier within estimated deadlines shown below. However the estimated time for dispatch of the order may vary depending on the courier/carrier service and the destination of the order:

- Portugal (Continental): 1 to 2 business days;
- Portugal (Islands): 3 to 5 business days;
- Europe: up to 5 business days;
- United States of America: up to 7 business days;
- Other Countries of the World: up to 9 business days

The order will be sent to the indicated recipient and address. The address mentioned is the sole responsibility of the customer.

14. Disclaimer

"Milla Chang Arts" is not responsible for the misuse or negligent handling of items purchased by the Customer, nor for their inadequate maintenance.
The items, whether original paintings or printings are respectively made with "Chinese inks" on rice paper and digital printing on bond paper. Therefore the Customer must keep in mind the fragility of the paper, handling it carefully and keeping it protected by applying a glazed frame or other suitable type of protection.

IMPORTANT: paintings and printings must be kept in environments with relative humidity of air less than 65%.

Like all materials, paper can present dimensional variations depending on the relative humidity of the air in the room where it is located. Thus, it is normal paper to present slight distension during days of higher humidity and, on the opposite, on drier days (low humidity relative to the air) to presents a slight contraction.
